Intellectual Property
Intellectual Property
Intellectual property is a category of property that includes intangible creations of the human intellect. Intellectual Property refers to creations of the mind, such as inventions; literary and artistic works; designs; and symbols, names and images used in commerce. The law recognizes these intangible creations of the intellect and offers them protection through the use of trademarks and copyrights.
Trademarks
Trademarks protect names, terms, and symbols that identify and differentiate a company and its goods while providing the consumer the ability to distinguish one company’s goods from another’s.
A trademark can include phrases, symbols, or designs, as well as images, colors, sounds, and even smells. A trademark offers protection against improper use by allowing the owner of a federally registered trademark to sue the owner of goods—or a company—that might infringe upon the trademark. Anderson and Associates, P.A. provides the following trademark services for our clients:
- Comprehensive Trademark searches (State and Federal)
- Trademark Filing/Registration (State and Federal)
- Trademark Monitoring

Copyrights
A copyright protects original, creative works fixed in a tangible medium; this includes books, movies, songs, photos, artistic creations, web content, choreography, poetry, and writing. Copyright protection for a creative work is automatic, so it isn’t necessary to register a creative work to receive some level of protection for it. However, registering your work with the United States Copyright Office does afford you more rights and protection when infringement occurs. Anderson and Associates, P.A. provides the following copyright services for our clients:
- U.S. Registration of Copyrighted Works
- Prosecuting and Defending Copyright Infringement Disputes
- Licensing of Copyrighted Works
- Negotiation and Handling Ownership Disputes
