Disadvantaged Business Enterprise / Airport Concessions DBE Owners: Don’t Wait for Decertification
If you are a DBE or ACDBE owner, your certification is entering a new, highstakes era. The USDOT Interim Final Rule (IFR) has eliminated the rebuttable presumption of social disadvantage. Now, every majority owner must prove social and economic disadvantage under a “more likely than not” standard with a detailed Personal Narrative and a current Personal Net Worth Statement. Your certification is no longer routine or automatic.
I work with DBE and ACDBE firms across the country to meet this new reality—whether you need help with a fresh DBE/ACDBE application, a reevaluation Personal Narrative, or a Personal Net Worth Statement that will withstand scrutiny.
What Certifiers Expect Now
Your Personal Narrative must provide individualized proof of disadvantage—real events from your life and business, not generic language. That means clearly describing:
– Barriers in education – denied or discouraged access to programs, financial obstacles, or being steered away from more lucrative paths.
– Barriers in employment – being passed over for promotions, paid less than similarly qualified peers, or facing retaliation when you raised concerns.
– Barriers in business – denied credit or bonding, harsher terms than similarly situated firms, lost contracts, or being limited to small or “token” scopes of work.
For each key incident, certifiers want to see what happened, when, who was involved, and how it caused economic harm—lost income, delayed growth, higher costs, or missed opportunities.
Your Personal Net Worth Statement must be accurate and complete, including assets, liabilities, business interests, real estate, and recent transfers. Incomplete or inconsistent information triggers questions at the very moment you can least afford delays.
Why Even “Successful” DBEs Need a Strong Narrative
Many DBE/ACDBE firms now have strong revenues, major contracts, and long track records. That success does not erase disadvantage. The real question is whether you had to work harder, longer, or at greater risk than similarly situated nondisadvantaged owners to get where you are.
Documenting that reality with facts, not just conclusions, is essential under the IFR.
Why I’m Well Positioned to Help
I bring nearly 40 years of experience in DBE, ACDBE, M/WBE, and small business programs nationwide, including:
– Drafting and implementing DBE and M/WBE plans for cities, counties, states, airports, expressway authorities, and transit agencies.
– Evaluating DBE/ACDBE applications and Personal Net Worth Statements for the Greater Orlando Aviation Authority and other public entities.
– Designing and implementing full-service compliance programs—goal setting, monitoring, payment tracking, dispute resolution, and reporting—for agencies such as Florida Turnpike Enterprise, Orlando Orange County Expressway Authority, Orlando Sanford Airport Authority, and multiple transportation authorities.
– Interviewing business owners nationwide and documenting their experiences with barriers and opportunities for disparity studies, which is directly analogous to building a compelling, factrich Personal Narrative.
This combination of program design, certification review, and evidence gathering experience means I understand your situation from both sides: as a supporter of DBE firms and as someone who has advised the agencies that evaluate you.
I offer consulting services nationally to:
– Prepare and refine DBE/ACDBE Personal Narratives under the new IFR.
– Review and strengthen Personal Net Worth Statements before submission.
– Assist with DBE/ACDBE applications and reapplications.
– Help you organize timelines, documents, and strategy for UCP reevaluation.
These services are consulting, not legal representation, and are available to DBE/ACDBE firms across the United States.
Act Before Your Deadline Hits
Every week you wait increases the risk of missed deadlines, rushed responses, and avoidable questions from your certifier. Your certification, contracts, and future opportunities are too important to leave to chance.
